Service Delivery
All deliverables are digital documents (PDF format) delivered to your email address on file. No physical delivery is included. Standard delivery: 48 business hours. Rush delivery: 24 business hours (requires Rush Add-On, purchased separately).
The delivery timeline begins only after we have received: (1) confirmed payment; (2) your floor plan, site sketch, or measurements in a readable format; and (3) a written description of your project requirements. Delivery occurs on business days (Monday to Friday, excluding Ontario and Canadian statutory holidays).
Incomplete Materials: If materials you provide are incomplete or unclear, the delivery clock pauses until complete information is received. We will notify you promptly. If we cannot commence work within 14 days of payment due to unreceived materials, we may cancel and refund at our discretion.
Ontario Consumer Right: If we fail to deliver your completed design within 30 days of the agreed delivery date through no fault of your own, you have the right to cancel and receive a full refund under the Ontario Consumer Protection Act, 2002. This right exists regardless of any other term in this agreement.
Cancellation Rights
Ontario Consumer Protection Act Notice: If you are an Ontario consumer (an individual purchasing for personal, family, or household purposes), you may have statutory cancellation rights including a cooling-off period under the Consumer Protection Act, 2002. These rights exist by law and no term in this agreement cancels, limits, or replaces them. Contact Consumer Protection Ontario at 1-800-889-9768 or ontario.ca/consumerprotection for information about your rights.
Our voluntary cancellation policy (in addition to your statutory rights):
- Before work begins: Cancel within 24 hours of payment for a full refund, provided design work has not yet commenced. Email info@kitakosecurity.com with "CANCELLATION" in the subject and your order reference.
- After work begins: Once we confirm commencement of design by email, cancellations are subject to our Refund Policy (Section 7).
- Business clients: If purchasing on behalf of a registered business, CPA consumer cancellation rights may not apply. Commercial clients are subject to Section 7 exclusively.
Refund Policy
The following policy applies subject to your statutory rights under Ontario and Canadian law, which take precedence in all cases:
| Situation | Outcome |
|---|---|
| Cancelled within 24 hours, before work begins | Full refund |
| We fail to deliver within 30 days of agreed date (our fault) | Full refund (statutory right) |
| Delivered design contains errors due to our fault | Free revision or partial/full refund at our discretion |
| Cancelled after work commenced but before delivery | Up to 50% refund at our discretion |
| Delivered and accepted — change of mind | No refund (service fully rendered) |
| Errors caused by incorrect client-provided information | No refund; revision at applicable rate |
Refund requests must be submitted to info@kitakosecurity.com with your order reference and explanation. We respond within 2 business days. Approved refunds are processed within 5-10 business days.
Revisions Policy
| Package | Included Revisions | Additional Cost |
|---|---|---|
| Basic Design | None | $49.00 CAD per round |
| Professional Design | 1 round | $49.00 CAD per round |
| Enterprise Design | 2 rounds | $49.00 CAD per round |
A revision means modifications to the delivered design based on your written feedback (e.g., repositioning cameras, adjusting quantities, updating coverage zones). A revision does not include a full redesign, scope changes substantially different from the original brief, or corrections arising from incorrect client-provided information. Revision requests must be submitted within 14 calendar days of delivery, after which the project is deemed complete and accepted.
Client Responsibilities
To ensure accurate design delivery, you agree to: provide accurate floor plans or measurements; disclose all relevant requirements at time of order; respond to clarification requests within 48 business hours; confirm that any documents you submit are legally yours to share; verify with your installer that the delivered design meets local building codes and municipal regulations (this verification is the client's and installer's responsibility, not ours).
Accuracy of Information: We design based on what you provide. We are not responsible for inaccuracies resulting from incorrect, incomplete, or misleading information submitted by the client. In such cases, revision charges apply and no refund is owed.
Intellectual Property
Upon full payment and delivery, the project-specific design documentation becomes your property for use in connection with your described project. You may use it with any installer or contractor for lawful purposes related to your property.
Restrictions: You may not resell, sublicense, or commercially distribute our design documentation. You may not represent our work as your own for commercial purposes.
Our retained rights: We retain ownership of all design methodologies, templates, tools, and processes. We retain the right to use anonymized or generalized project representations as portfolio samples unless you explicitly request otherwise in writing at time of order.
Limitation of Liability
To the maximum extent permitted by Ontario and Canadian law, Kitako Security Design is not responsible for: physical installation, maintenance, or operation of any security system; prevention of theft, security breaches, or property damage; equipment malfunctions after installation by a third party; any damages arising from use of our designs by the client or installers; failure to comply with local codes (client's responsibility); or indirect, consequential, special, or punitive damages.
Maximum liability: Our total liability for any claim shall not exceed the total amount you paid for the specific service giving rise to the claim.
Note: Nothing in this section limits our liability for fraud, gross negligence, or any liability that cannot be excluded under Ontario or Canadian law, including under the Consumer Protection Act, 2002.
Privacy & Personal Information (PIPEDA)
We are committed to protecting your personal information in accordance with the federal Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy law.
We collect: name, email, and billing address (via Stripe at checkout); project details and floor plan files for design purposes; and anonymized website analytics data (Google Analytics, Microsoft Clarity). We use your information solely to complete your project, communicate with you about your order, process payments, and improve our services. We do not sell, rent, or share your personal information with third parties for marketing purposes.
Floor plan files are retained only as long as necessary to complete your project and revisions. Upon written request, we will delete your project files after project closure. To access, correct, or request deletion of your data, email info@kitakosecurity.com.

Force Majeure
We will not be held liable for delays or failures resulting from circumstances beyond our reasonable control, including natural disasters, internet outages, government actions, declared emergencies, cyberattacks, or infrastructure failures. We will notify you as soon as reasonably possible and work to resume services or arrange an appropriate resolution, including a refund if service cannot be delivered within a reasonable extended timeframe.
General Provisions
Entire Agreement: These Terms, together with any service description and pricing disclosed at time of purchase, constitute the entire agreement between you and Kitako Security Design and supersede all prior oral or written understandings.
Severability: If any provision is found invalid or unenforceable, the remaining provisions continue in full force.
Waiver: Failure to enforce any right does not constitute a waiver. Any waiver must be in writing.
Amendments: We may update these Terms at any time by posting changes with an updated date. Continued use of our services constitutes acceptance. Material changes will be communicated by email where reasonably practicable.
Electronic Contracting: Your electronic acceptance has the same legal effect as a written signature under Ontario's Electronic Commerce Act, 2000.
Language: These Terms are in English. In case of conflict with a translation, the English version prevails.
No Assignment: You may not assign your rights without our prior written consent. We may assign ours to a successor business.
Indemnification: You agree to indemnify Kitako Security Design against claims, losses, or damages arising from your breach of these Terms, misuse of our deliverables, or false information provided in connection with your order.
Governing Law & Jurisdiction
These Terms are governed by the laws of the Province of Ontario and applicable federal laws of Canada. Disputes that cannot be resolved through Section 13 are subject to the exclusive jurisdiction of the courts of Ontario, Canada.
Consumer Rights Preserved: Nothing in this section prevents an Ontario consumer from accessing statutory dispute resolution mechanisms available under the Consumer Protection Act, 2002 or other applicable legislation.
